Herbert Kraft Memorial Free Library Trust
This indenture made the 27th day of November, 1908, between Elizabeth Kraft, a widow, now residing in the City of Oakland, but formerly a resident of Red Bluff, California, the party of the first part, and the City (or town) of Red Bluff, a Municipal Corporation of the State of California, situated in the County of Tehama, party of the second part witnessth:
That the party of the first part does herby, give, grant, and convey unto the party of the second part, all that certain real property, situated in the town of Red Bluff, Count of Tehama, State of California, particularly designated and described, on the official plat of said town, as lots numbered 1, 2, 3, and 4 in block numbered 47. To have and to hold the said premised, in trust for the uses and purposes of a public library.
No portion of said property shall be used for any other purpose. The grounds shall be retained by said Municipal Corporation, for such uses and purposes as shall be deemed proper in connection with the said public library.
The building or buildings that are now or shall hereafter be constructed o the said premises shall be used exclusively for library purposes. But this grant is not intended to restrict such use so that the term library or other than the free uses and benefit library purposes, shall be understood to be used in any narrow or restrictive sense, but in its broadest terms, so as to include the use of said property, grounds, and building not only for books but for statuary, paintings, and all other purposes, consistent with its use for the purpose for which this grant is made, as above stated; any portion of the building or buildings now or hereafter on said premises, may be used for library schools, or lectures of other entertainments, conducted for the benefit of the library which shall be maintained on the said premises.
The building or buildings on said premised, and the books and statuary and paintings and other things therein shall ever be known and designated as the “Herbert Kraft Free Public Library”, and shall at all times during reasonable hours be kept open for the use of the public under such reasonable regulations, as shall be from time to time made by the Board of Library Trustees, or other body which shall have the management and control of said library, but there shall be no restrictions of any kind, based on racial lines, color, or religion. Nothing herein shall be constructed to grant to any person or persons not a resident of said Municipal Corporation any rights in the said library, other than, and in addition to such rights as shall be from time to time extended by the Board of Library Trustees, or other body and control of the said library.
If the said property herein conveyed shall at any time be abandoned by the said town of Red Bluff, or if the said property shall cease to be used for library purposes, by said town, or shall be put to any use other than the uses and purposes herein specifically referred to, or, if the library shall at any time be placed, or attempted to be placed upon any basis other than for the free use and benefit of the inhabitants of the town and such other persons as may by the governing body of said library be given the right to use the same, or if the said City of Red Bluff shall make any conveyance of the said premises, or any portion thereof, or if any attempt shall be made by the governing body of the said municipality to change the name hereinabove designated, for the said property, then the grant and conveyance herein made shall cease and terminate and the title to the said property, and all the improvements thereon shall at once rever to the party of the first part, or to her heirs or assigns.
In witness whereof, the party of the first part has hereunto set her hand and seal, the day and year first in this certificate written.
